윤미향 의원 2심 판결에 대한 해외 시민단체 성명서

윤미향 의원에 대한 2심 재판에서 20일 서울고법 형사1-3부(부장판사 마용주·한창훈·김우진)는 사기 등 혐의로 기소된 윤 의원에게 1심과 달리 징역 1년 6월에 집행유예 3년을 선고했다.

지난 2월 10일 1심에서는 거의 모든 혐의가 무죄로 인정됐고, 횡령 1700만원에 벌금 1,500만원이 선고 되었다. 그런데, 2심 재판부는 이보다 훨씬 많은 형량을 선고했다.

우리는 이번 2심 재판 결과에 많은 의구심을 가지게되며 상고심을 통해  당당히 무죄가 입증 될것임을 확신한다.

윤미향 의원이 살아온 인생 대부분은 정대협(정의연) 활동이라 해도 과언이 아니다. 그 어렵고 힘든 싸움을 통해 만들어진 효과는 일본군‘위안부’ 문제를 국제사회에 알리고 일본의 역사 왜곡의 실체를 세상에 드러내는 커다란 결과물을 만들어 냈음을 역사가 증명하고 있다. 이 기간 윤미향 의원이 겪었던 세월이 힘들고 어려웠던 시간이었음을 우리는 너무도 잘 알고있다.

우리는 윤미향 의원에 대한 2심 사법부의 판단은 1심에서의 무죄로 판결된 일부까지도 유죄로 인정한 무리한 판단이었다고 생각한다. 따라서 대법원 상고를 통해 반드시 그 진실이 밝혀지고 규명될 것임을 확신하며 윤미향 의원도 이번 판결에 굴하지 않고 진실 규명에 적극 나서줄 것을 요청한다.

진실은 반드시 밝혀질 것이다.

우리는 끝까지 윤미향 의원에 대한 믿음과 신뢰를 가지고 대법원의 판단을 지켜볼 것이다.

Statement by overseas grassroots civil organizations
regarding Rep. Yoon Meehyang’s second trial ruling

On 20 September 2023, the Seoul High Court sentenced Korean Congresswoman Representative Yoon Meehyang to 1 year and 6 months in prison (which can be served as a 3-year probation) on the charges of fraud. This was her second trial which, unlike the first trial, handed down a sentencing of imprisonment instead of a fine.

During the first trial held on 10 February 2023, she was found not guilty on almost all charges and was found to be guilty of embezzlement of 17 million won with a fine of 15 million won. She appealed this claiming she has not sought personal gain from her so called “Comfort Women” activism activities with the Korean Council for Justice and Remembrance for the Issues of Military Sexual Slavery by Japan (the Korean Council). However, the second trial reversed a number of decisions from the first, resulting in a harsher sentence.

We have many doubts about the results of this second trial. Rep Yoon will be appealing this decision, and we are confident that her innocence will be proven at the higher court.

Rep Yoon's life has been related to the activities of the Korean Council for the victimised survivors of the so called “Comfort Women” system. As grassroots activists, we have worked in collaboration with Rep Yoon for many years and decades, including fundraising and administrating funding received for campaign and advocacy work. We know very well that this activist’s commitment and integrity have stood the test of time and hardship, and we have not found evidence against her to be consistent nor interpreted in good faith by the prosecutors and the courts. We suspect that Rep Yoon’s indictment and sentencing on charges of fraud and embezzlement is related to discrediting the efforts by all activists working towards finding justice on the so called “Comfort Women” issue of Japanese Military Sexual Slavery during WWII.

We believe that

the second trial judgment against Rep. Yoon was an unreasonable because it recognized accounts that were found not guilty in the first trial as guilty, without change in circumstance or misuse of the law.

We request that

Representative Yoon Meehyang’s sentencing is reviewed and overturned by review of the Supreme Court.

We, the grassroots activists stand in solidarity with Justice for the so called “Comfort Women”, will await the Supreme Court's judgment in hope and faith in Representative Yoon Meehyang.
